Section 69 of the 1999 Constitution (as amended) grants you the power to recall an underperforming Senator or Member of the House of Representatives before their tenure ends.

The Legal Process

The Petition & Signatures

Draft a petition stating your absolute loss of confidence in the legislator. You must gather physical signatures from more than half (50% + 1) of the registered voters in that specific Senatorial District or Federal Constituency.

Submission to INEC

The petition, alongside the collated signatures and Voter Identification Numbers (VINs), must be formally presented to the Chairman of the Independent National Electoral Commission (INEC).

INEC Verification

INEC has 90 days from the date of receipt to verify the signatures. They will cross-reference the signatures and VINs with the official voter register for that constituency to ensure authenticity.

The Referendum

If the signatures are verified, INEC will conduct a referendum (a yes/no vote) in the constituency. If a simple majority of the voters vote "Yes" to recall, the legislator's seat is declared vacant.
